TERMS & CONDITIONS OF CLUB CONTRACT

 

MEMBERSHIP QUALIFICATIONS: Subject to approval by Concorde Health & Wellness (CHW), without regard to race, sex, ethnic background or religion, any individual 12 years of age or older, is eligible for membership at Concorde Health & Wellness. Membership in the Club includes a member's right to use the Club's facilities in accordance with these Terms and Conditions and Rules, Regulations and Club Policies which may be amended from time to time.

CONSUMERS RIGHT TO CANCELLATION: You may cancel this‑agreement without any penalty or further obligation within seven (7) days from your joining date or the date the facility is available for your use, which ever is later. Your notice of cancellation must be in writing, signed by you, and sent to Concorde Health and Wellness.. You must return with your notice of cancellation all agreements, documents or any other evidence of membership in the Club.

ADDITIONAL RIGHTS TO CANCELLATION: You may cancel this agreement for any of the following reasons. Consumer has the right to a pro rated refund in the event that they paid a lump sum for their membership and they cancel prematurely for one of the following reasons.

I .                   If, upon a medical doctors written order, you cannot physically receive the services because of significant physical disability for a period of excess of three (3) months.

2.                    If you move your residence more than twenty‑five miles from Concorde Health and Wellness or Concorde Therapy Group and we cannot secure privileges at a comparable facility.

3.                    If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing.

4.                    If the services cease to be offered as stated in the agreement.

MEMBERSHIP DUES AND CHARGES: Your membership in the Club is a one year or six month (where available) automatically renewing agreement, payable annually or on a monthly basis. Membership constitutes a contractual commitment to pay Club dues on a yearly basis. Withdrawals from the Club, except for detailed reasons listed under "Additional Rights to Cancellation", will not relieve a member from fulfilling his/ her agreement obligation. This yearly membership agreement is automatically renewable, without notice, each six month or year unless written notice of intent to cancel by either party is received at least thirty (30) days prior to the anniversary date. The notice may be filled out at the front desk or a letter signed and sent via certified mail. Cancellations will then become effective on the last day of the month following the month in which the notice is submitted. Your Renewal Date is:

MEMBERSHIP CATEGORIES: Single membership is available to any individual who qualifies for a membership to Concorde Health & Wellness. Couple membership is available for two individuals who are married or siblings that occupy the same residency. Family membership consists of two adults and four children who occupy the same residency.

MEMBERSHIP CATEGORY CHANGES: A member in good standing may add a spouse or family member to their individual membership at any time thus altering their membership category. However, a change in category shall constitute an automatic yearly renewal of his/ her membership which will alter their anniversary date accordingly. A member in good standing may assume a new membership category by removing a spouse or family member on their anniversary date only. Any change in membership category will be effective on the first day of the month following the Clubs written acknowledgment of the change in category. Memberships are non‑transferable

CLUB DUES AND FEES: The Club, at its option, may increase dues from time to time. Members will be notified at least sixty (60) days prior to any increase in Club dues. Dues will not be adjusted during times when the Club is repairing or renovating any of its facilities. Your membership is a six month or one year automatically renewing contract, payable annually or monthly through Electronic Funds Transfer (EFT) of a personal checking account and/ or major credit card.

LOCKER AND SHOWER FACILITIES: Locker and shower facilities are provided for members convenience. Locks are not provided, and Concorde Health and Wellness will not accept responsibility for lost or stolen articles. Locks are to be removed daily, Concorde Health and Wellness reserves the fight to remove locks daily and articles in the locker will be stored in lost and found.

REFRESHMENTS: Complimentary coffee is available at the Control Desk and drinking fountains are located throughout the facility. Open containers are not allowed in any of the exercise areas, however closed water bottles are permitted.

VISITOR AND FAMILY PARTICIPATION: Education and cooperation of family members or others who will be assisting with exercise activities is an important part of the services provided by Concorde Health and Wellness. Assistance by family members must be approved in advance with the Fitness Manager.

CHILD CARE/ SUPERVISION (Alliance & Hartville): Concorde Health & Wellness does provide child care. Please see attached rules & regulations for this program.

CHILD CARE/ SUPERVISION (Belden Village): Concorde Health and Wellness does not provide child care or child supervision during visits, and will not accept liability for children who are left unattended or who attempt to play on or near exercise equipment. In the interest of the child's safety and other members and guests, we ask that you make arrangements for child care during your exercise visits.  

PHYSICAL ACTIVITY AREAS:

Exercise Equipment Areas:

      Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.

      Please observe the 20 minute time limit on treadmills, and 30 minute time limit on all other cardiovascular equipment during the Club's peak usage. Please ask staff for peak usage times

      Instruction in the proper use of all equipment is the responsibility of each member.

      Proper Care and use of all equipment is the responsibility of each member. Please clean equipment after use.

      Use of equipment is at the member's risk

      Please be safe! Ask your Concorde Health and Wellness staff for assistance.

 

Swimming Pool

      Pool is open during Club hours only

      Pool is a multi‑purpose facility that may be used for Physical Therapy, lap swimming, water exercise classes to name a few. Pool scheduling is subject to change.

      Everyone must shower first before using the pool.

      Members swim at their own risk

      Horseplay will not be tolerated

      No diving allowed

      Proper swimming attire required, no cutoffs

 

Group Exercise Room

      Members and guests are required to wait outside the room until the next class begins.

      Horseplay will no be tolerated. Proper etiquette shall be enforced at all times

      Aerobic studio A/V equipment is for the exclusive use of Concorde Health and Wellness staff.

 

RULES, REGULATIONS AND CLUB POLICIES

CONCORDE HEALTH AND WELLNESS HOLIDAY HOURS:

MEMBERSHIP NUMBER: Each member is issued a membership number. Members must present their membership number at the Control Desk and be cleared by Desk personnel to gain access to Concorde Health and Wellness.

GUEST POLICIES: A guest must be accompanied by a member, must register and obtain a guest pass at the Control Desk prior to using the club. All guests are required to complete a Physical Activity Readiness Questionnaire (PAR‑Q), and an Assumption of Risk. Arrangements for unaccompanied guests must be made in advance with the Fitness Manager. Unregistered guests will be asked to leave Concorde Health and Wellness immediately. Expelled or suspended members may not come as the guest of another member.

A guest may use Concorde Health and Wellness no more than seven (7) days per year. An out‑of‑town gust card may be issued for a period not to exceed one (1) month. The card may be requested at the Control Desk.

EMERGENCY PROCEDURES: Should an accident occur at Concorde Health and Wellness, immediately report it to the Control Desk or notify any staff member. Emergency procedures will be immediately expedited. Should you or a family member become injured while at Concorde Health and Wellness, Club staff is not permitted to provide transportation anywhere. We reserve the right to call an ambulance. All members are encouraged to be CPR certified.

LOST AND FOUND: Concorde Health and Wellness is not responsible for items lost, stolen or damaged. Lost and found item inquiries should be made through the Control Desk. Items turned in and not claimed after thirty (30) days will be donated to local charities.

TELEPHONE MESSAGES AND OUTGOING CALLS: If you wish to receive a message while at Concorde Health and Wellness, check in at the Control Desk and they will be held for you. Paging in the Club is used for emergencies only. Local outgoing calls are prohibited from Concorde Health and Wellness phone system, however calls are subject to approval.

PHYSICAL ASSESSMENT: All Concorde Health and Wellness members participate in a computerized physical fitness assessment through the Performance Lab. This is a vital, value added, service which allows the Concorde Health and Wellness staff evaluate a number of physiological parameters including health risk factors. The information is then used to design an individualized exercise prescription accordingly.

TOWELS: Towels are provided for use during exercise and are for the convenience of the members, and should not be removed from the facilities. The club will hold either a photo I.D. or keys at the front desk to secure the return of towels to the Club.

SMOKING: Concorde Health and Wellness is a smoke free environment for staff, members, patients, and guests.

CLOTHING AND HYGIENE: Shirts, shorts, sweat suites, leotards, workout tights and athletic shoes must be worn in all areas of Concorde Health and Wellness. No turf shoes or cutoffs are permitted. Members wearing bathing suits must have appropriate "cover-ups" when outside the pool area. Members are asked to be considerate of staff and other members in maintaining adequate personal hygiene.

REVISION/ CHANGES: The membership fees, yearly dues, charges, membership Rules, Regulations and Policies, and the Clubs Terms and Conditions are subject to change by the Club management from time to time. Members may be notified of such changes in any manner which Club management deems appropriate.

PAYMENT POLICIES: Members may choose to pay for their annual or six month membership in full. The Club will accept cash, check or major credit card in an amount equal to the full annual value of the appropriate membership category. Members who choose to pay for their membership monthly will be required to pay the appropriate one time enrollment fee at the time of joining and monthly dues will be collected on the first of each month (in advance of the month services will be delivered) through automatic checking and/ or credit card draft. (EFT). Monthly payments delivered in person to the Concorde Health and Wellness Control Desk prior to the twenty‑fifth (25) of each month will negate the automatic EFT for the following month. Fees for programs, services, and products may be paid for at the control desk with cash, check or major credit card or may be applied to your monthly EFT. Member agrees to pay collection costs incurred by the Club in collecting any past due amounts, including court costs and reasonable attorney's fees. Member also agrees to pay a $20.00 handling fee for any declined, closed or non‑sufficient fund return.

DAMAGES: Members are responsible for damage to Club property and/ or property of other members and their guests caused by themselves or their guests, except that due to ordinary wear or usage.

TERMINATION OF MEMBERSHIP: The Club may terminate for cause any membership by mailing notice in writing to the last address shown on the records of the club for the member being terminated. The terminated member will be required to return promptly any Club property currently in their possession. A terminated member will remain liable for all dues and other indebtedness incurred until their membership anniversary date. Use of Club facilities is available only to members in good standing and their guests. A member in good standing is one who has no outstanding membership dues or club charges over thirty (30) old, or has no reports of misconduct in his/ her personal file.

CHANGES TO THIS CONTRACT: The Club's membership Application and Agreement, Rules, Regulations and Club Policies, and Terms and Conditions of Club Membership are the entire agreement between the Club and the member. In the event any part of these agreements are found in court to be invalid or unenforceable, such part shall be deemed stricken and the remainder of the documents shall remain in full force and effect. Failure to abide by these documents may result in termination of membership.

LEAVE OF ABSENCE: A member may request a leave of absence from the Club by a written notice received by the Club not less than thirty (30) days prior to the agreement anniversary date. A leave of absence may also be granted at any time as described in "Additional Rights to Cancellation". The leave of absence has to be in one month increments and there are only two leave of absences granted per calender year of a maximum of four months. If the member left the Club in good standing, a member will be readmitted to the Club within one (1) year following a grant of a leave of absence, if the member pays an amount equal to all monthly dues which would have been due from the elective date of the leave of absence to the date of readmission. Any requests for leave of absence must be received at the front desk prior to the requested dates for leave of absence and all leave of absences are subject to review and approval by Concorde Health and Wellness management.

INITIATION OF SERVICE: Contracted Concorde Health and Wellness services will begin no later than 120 days from the date this agreement is entered into.

CESSATION OF SERVICES: In the event that Concorde Health and Wellness relocates or closes the facility, Concorde Health and Wellness will be obligated to find a substantially similar facility which will assume the membership agreements with member. In the event that Concorde Health & Wellness is unable to find a substantially similar facility, it will provide to member a prorated refund of the monthly membership fee paid by member.
